The W. Tresper Clarke High School in Garden City, NY has refused to let a deaf student bring his service dog to school. They claim it is in the best interest of the student body and could pose a risk to faculty and other students safety and health.
The dog’s owner had filed a $150 million federal lawsuit against the East Meadow School District last year over the matter, but the case was dismissed.
Even though the state law prohibits educational institutions from denying access to their facilities to people with disabilities, the Superintendent of the school district said he would only admit the dog if a court ordered it. So far the Human Rights Commission has not sought a court order.
